ABSTRACT
O presente artigo tem como objetivo discutir o contrato social a partir das bases teóricas da democracia deliberativa que está ligada a ética discursiva. Para tanto, partiu-se da indagação acerca daspossíveis contribuições que a matriz da democracia deliberativa traz para o contrato social a partir do paradigma dos direitos fundamentais no constitucionalismo contemporâneo. Partindo-se de tal indagação busca-se primeiramente definir as questões preliminares fundamentais a compreensão do papel da linguagem a partir da reviravolta lingüística, para a posteriori discorrer sobre a ética discursiva enquanto orientação para a comunicação intersubjetiva, para, finalmente, expor pressupostos da democracia deliberativa como forma de identificar suas contribuições para o contrato social no constitucionalismo contemporâneo, calcado na lógica de reconhecimento e concretização dos direitos fundamentais. Dito isso, pode-se concluir que, a democracia deliberativa privilegia um ambiente intersubjetivo para a produção de consensos destinados a criar, proteger e concretizar direitos fundamentais, como verdadeiros paradigmas do neocontratualismo.
This article has the purposeof to discuss the social contract from the theoretical bases of deliberative democracywhat is united to the discursive etichs. It is questioned about the possible contributions that the matrix of deliberative democracy brings to thethe social contract starting the paradigm of fundamental rights in the contemporary constitutionalism. Starting from this question, firstly it has been sought to define the preliminary fundamental questions about the understanding of the role of language from the linguistic spinning , to a posteriori discuss about the discursive ethics as orientation for subjective communication, to, finally, to expose the assumptions of deliberative democracy like a way of identify its contributions to the social contract in the contemporary constitutionalism, supported by the logic of recognizing and achievement of the fundamental rights. That said, it is possible to conclude that the deliberative democracy privileges an intersubjective environment to the production of agreements destined to create, to protect and to achieve fundamental rights, as true paradigms of the neocontractualism.
